“It is a common misconception that Will Writing and Legacy Planning is for the RICH, Old or Dying”

The Issues to Grapple with

Many people agonize over the best ways to distribute various assets to their spouse and children. Should it be given equally, or should some have more than others?

Should the assets be separately given or should they be shared? If shared, would this cause friction and dispute over asset usage or disposal?

Many of us have the habit of bringing a charged power bank with us, when we head out of the house for a long day ahead at work. This habit offers us the sense od security and assurance in the event our mobile phone(s) run out of battery.

Estate Planning embodies the same concept. It offers us the sense of security and assurance in the event death falls upon us unexpectedly.

Will writing is for Every Person
In truth, Will writing is for every person with specific distribution wishes for their assets upon death or mental incapacity.

We spend countless years, sweat and tears accumulating wealth. That essentially includes every person with property ownership, bank savings, insurance coverage, investment portfolio and/or business ownership.

Legacy planning is especially necessary for business owners and families with minor children and/or elderly parents.

Enhanced consideration needs to be given to beneficiaries who are young and below 18 years old and it is always wise to set up a Trust to hold the funds for beneficiaries until the right timing of the beneficiary to manage their finances.

The Role of Estate Planner

The multitude of potential issues is often underestimated by the client. The subject is wide in scope and is highly technical with many issues to be grappled with as mentioned in the earlier paragraphs.

Jocelline is able to understand the wide scope of issues that need to be addressed in a person’s legacy plans. She will be able to identify the triggers that the clients can relate to.

Property Distribution – In Full, In Part, In Cash?

Property distribution should be a blessing, not a curse. Review how you can adequately include your minor, parent and spouse in your property distribution. Property is usually the biggest item on our list of assets. Given that property is mortar and brick, homeowners need to clearly consider the various options available for the distribution of their property.  There are many obstacles in property distribution, that can eventually make the property inheritance a burden and source of conflict for your appointed beneficiaries. A few points to consider is listed as follows: -  Minors  are legally ineligible to inherit a property. - The law restricts the possession and inheritance of government subsidized property. When you have a Will, your Executor is the most important person you put in charge to carry out your Will instructions.   Without a piece of knowledge and capable executor your instructions may not carry out and your beneficiaries may not receive their inheritance. Executor may expose to Liabilities Your executor may be exposed to liabilities from creditors and tax authorities. Thus your executor must familiar with legal steps involved in executing your Will and can be trusted to be unbiased in the distribution of your assets.   Instead of letting inexperienced Executor act as your Executor. As yourself this question.... Do I know the duties and liabilities of an Executors If I don’t know, how I do brief my Executor on what to do? Has he agreed to act as my Executor? Is he too busy to act as my Executor? Will he still be trustworthy when I’m no longer around?
